The program will provide an overview of current trends and wage and hour issues currently impacting the Energy Sector – FLSA misclassification and contractor issues – and highlight labor and employment law requirements and best practices in the event of a layoff. Additionally, it will address the special obligations and consequences for Foreign National employees that are terminated.

Some of the issues to consider are:

  • Will there be liability for return transportation costs back to the home country?

  • Why is notification to USCIS and the Department of Labor important?

  • Valid immigration status ends as soon as employment ends – what are other possible visa options to remain in the U.S.?

  • Can any part of the permanent residency process be salvaged for employees that are being sponsored for green card?

Speakers

Marc D Katz is a trial attorney and Chair of Andrews Kurth’s Labor & Employment Section. He represents corporate clients on management-side labor and employment litigation, as well as commercial litigation. He has first chaired more than 50 proceedings to verdict, including jury trials, bench trials, arbitrations, and administrative law proceedings, with an impressive record of success. Marc is Board Certified by the Texas Board of Legal Specialization and is a frequent speaker and author on labor and employment topics. He has been repeatedly recognized as a "Texas Super Lawyer" by Texas Monthly Magazine and a best lawyer in Dallas by D Magazine. Outside the office, Marc is a member of the board of directors of Dallas Urban Debate Alliance and the Red Cross Blood Services.

Judy J. Lee is a partner with Foster LLP. She is a native Houstonian and received her law degree from the University of Houston Law School. She is Board Certified in the area of Immigration and Nationality Law by the Texas Board of Legal Specialization. Ms. Lee has been named by Chambers U.S.A. as a "Leading Individual for Immigration Law in Texas", a "Texas Super Lawyer" by Texas Monthly Magazine, one of "Houston's Top Lawyers" in Immigration Law by H Texas Magazine, and has been included in "The Best Lawyers in America" and "Who's Who Legal- Texas".
