The program will provide an overview of current trends and wage and hour issues currently impacting the Energy Sector – FLSA misclassification and contractor issues – and highlight labor and employment law requirements and best practices in the event of a layoff. Additionally, it will address the special obligations and consequences for Foreign National employees that are terminated.

Some of the issues to consider are:

  • Will there be liability for return transportation costs back to the home country?

  • Why is notification to USCIS and the Department of Labor important?

  • Valid immigration status ends as soon as employment ends – what are other possible visa options to remain in the U.S.?

  • Can any part of the permanent residency process be salvaged for employees that are being sponsored for green card?



Marc D Katz is a trial attorney and Chair of Andrews Kurth’s Labor & Employment Section. He represents corporate clients on management-side labor and employment litigation, as well as commercial litigation. He has first chaired more than 50 proceedings to verdict, including jury trials, bench trials, arbitrations, and administrative law proceedings, with an impressive record of success.
