Current Version of Form I-9 Valid Until January 21, 2017

The U.S. Citizenship and Immigration Services (USCIS) has recently confirmed that employers may continue to use the current version of Form I-9 with a revision date of 03/08/2013 N until January 21, 2017, which will give employers a grace period before having to use the new Form I-9 that has yet to be issued. After January 21, 2017, all previous versions of the Form I-9 will be invalid.

The new Form I-9 was recommended on August 25, 2016 by the Office of Management and Budget (OMB), which approved the revisions to the form and cleared it for publication. The new Form I-9 must be issued by USCIS by November 22, 2016. The newly revised I-9 will include some “smart I-9 features” and several new “structural” changes and instructions, which will be important for all employers to know and learn. According to the OMB Notice of Action, the new Form I-9 will have an expiration date of August 31, 2019.
