April 2020 Visa Bulletin – USCIS Will Utilize Final Action Dates; Consider Filing in March if Eligible under Dates for Filing

The U.S. Department of State (DOS) published the Monthly Visa Bulletin for April 2020, which most significantly shows modest forward movement in the Final Action Dates of backlogged EB-1 chargeability areas, with little to no movement of the Final Action Dates for other preference categories. 

U.S. Citizenship and Immigration Services (USCIS) confirmed on its website that beneficiaries of approved employment-based immigrant visa filing during the month of April should rely upon the “Final Action Dates” when reviewing the April 2020 Visa Bulletin for eligibility to file adjustment of status applications.

In recent months, USCIS had allowed beneficiaries to file under the typically earlier “Dates for Filing,” so foreign nationals may wish to review the “Dates for Filing” below, which are the same as in the March Visa Bulletin, to determine whether they are eligible to file in March but not April and, if so, consult with an immigration attorney to file in March.
