DHS Confirms Termination of Haiti TPS

On June 27th, The Department of Homeland Security (DHS) announced the termination of Temporary Protected Status (TPS) for Haiti. The termination will be effective September 2, 2025. The Secretary of Homeland Security determines whether a country continues to meet the conditions for TPS designation at least 60 days before the current TPS designation expires. In this case, Secretary Kristi Noem determined that Haiti no longer meets the statutory requirements for TPS. 

Previously issued EADs under Haiti’s TPS designation will automatically be extended through September 2, 2025. These EADs include those with the notation A-12 or C-19 under Category with a “Card Expires” date of February 3, 2026, August 3, 2025, August 3, 2024, June 30, 2024, February 3, 2023, December 31, 2022, October 4, 2021, January 4, 2021, January 2, 2020, July 22, 2019, January 22, 2018, and July 22, 2017. 

Employers and their employees are encouraged to review potential impacts of the TPS termination and to consult with an immigration attorney regarding gaps in employment authorization and the right to remain in the United States.
