DHS Secretary Noem Partially Vacates Prior Haiti TPS Extension and Designation

The Department of Homeland Security (DHS) Secretary Noem is partially vacating a prior Temporary Protected Status (TPS) extension and new designation for nationals of Haiti, with publication in the U.S. Federal Register today, February 24,2025.
With the partial vacatur, Secretary Noem limits the July 2024 extension and redesignation of Haiti for TPS to August 3, 2025, six months earlier than the previously designated expiration of February 3, 2026. Secretary Noem has until June 4, 2025 to review the TPS designation, or else an automatic 6-month extension will take effect.
The publication of the partial vacatur indicates USCIS will not recall TPS-related documents—including Employment Authorization Documents (EADs), I-797 approval notices, and I-94 arrival/departure records—that have already been issued with validity through February 3, 2026. However, as a result of the vacatur, such documents are now valid only through August 3, 2025, unless Secretary Noem determines an extension of TPS for Haiti is warranted.
The publication of the partial vacatur further indicates that employers “that previously accepted or are presented with an EAD with the TPS category code of A-12 or C-19 that expires on February 3, 2026, must update their records to note that the validity date of the document is through August 3, 2025.”
