Final Phase of Premium Processing Expansion Announced by USCIS

U.S. Citizenship and Immigration Services (USCIS) will implement, starting January 30, 2023, the final phase of the premium processing expansion of Form I-140 Immigrant Petitions filed under the employment-based EB-13 and EB-21 classifications. USCIS will accept Form I-907 requests for premium processing for all pending and initial EB-13 multinational executive and manager petitions and EB-21 national interest waiver (NIW) petitions.

Unlike previous premium processing expansions, this phase includes both pending and new petitions.
If premium processing is requested for an I-140 Immigrant Petition filed under the EB-13 and EB-21 NIW classifications, USCIS will respond within 45 calendar days.

For other I-140 Immigrant Petitions eligible for premium processing, USCIS will respond within 15 calendar days. A response may be an approval, denial or request for evidence.
USCIS intends to further expand premium processing options to additional form types, such as Form I-765 applications for employment authorization for F-1 students and Form I-539 applications to extend or change a nonimmigrant status.
