Syria TPS Designation Terminated by DHS

23 Sep

On September 19, 2025, the Department of Homeland Security (DHS) announced termination of the designation of Temporary Protected Status (TPS) for Syria, which was set to expire on September 30, 2025.

Per the Federal Register Notice that was published on September 22, 2025, the TPS designation for Syria will terminate at 11:59 p.m. on November 21, 2025.

  • What Does This Mean for Affected Beneficiaries?

Individuals with TPS Syria designation will no longer have TPS status after November 21, 2025. Impacted individuals must depart the United States before that date unless they hold another valid immigration status.

The Federal Register Notice automatically extends the validity of certain Employment Authorization Documents (EADs) previously issued under the TPS designation, so Syria TPS beneficiaries will continue to be authorized for employment during the 60-day transition period.

  • What Does This Mean for Employers?

As proof of continued employment authorization during the 60-day period, TPS beneficiaries can show their EADs that were issued under the A-12 or C-19 categories.

If an employer continues to employ workers after November 21, 2025, they do so at the risk of being charged with knowingly employing a foreign national who is not workauthorized in the United States.

Additionally, for those employers enrolled in E-Verify, if the E-Verify Change Status Report indicates the employee’s EAD has expired, then employers must ask the employee for additional proof of work authorization.

Foster LLP will continue to monitor any anticipated and ongoing changes with TPS designations that will affect immigration benefits and will provide additional updates via our firm’s website at fosterglobal.com.
